Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of BLVD ("BLVD," "we," "us," or "our") and its website located at blvd.ph (the "Site"), together with all related features, including the Contributor Portal, Writers Leaderboard, Rankings, Events, Spotlight, Newsletter, My Library, and any other tools or content we make available (collectively, the "Services"). By accessing or using the Site, creating an account, submitting content, subscribing to our Newsletter, or otherwise using the Services, you agree to be bound by these Terms, our Privacy Policy, Cookie Policy, Child Protection Policy, PSEAH Policy, AI Usage Disclaimers, and Journalistic Ethics statement (collectively, the "Policies"), each of which is incorporated by reference. If you do not agree, you must not use the Services. You must be at least 18 years old, or the age of legal majority in your jurisdiction, to create an account or use the Services.

1. Description of Services

BLVD is a digital lifestyle magazine and management platform for remote and virtual professionals, offering original editorial content, contributor tools, rankings and recognition features, event listings, and integrated sponsorship and advertising services for brands. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

2. Accounts and Registration

Creating an Account To access certain features (e.g., My Library, the Contributor Portal, or Newsletter preferences), you may need to register for an account. You agree to provide accurate, current, and complete information and to keep it updated. Account Security You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use via our Login/"Forgot Password" support channels. Eligibility and Suspension We reserve the right to refuse registration, suspend, or terminate any account at our discretion, including for violation of these Terms, our editorial standards, or applicable law.

3. Contributor Terms

Applying to Contribute Individuals may apply to write, pitch, or otherwise contribute content through the "Contribute" page and Contributor Portal. Submission of a pitch or article does not guarantee publication. Editorial Discretion BLVD retains full editorial discretion over whether to accept, edit, publish, feature, or remove any submitted content, consistent with our Journalistic Ethics standards. Content Ownership and License Unless otherwise agreed in writing (e.g., a separate contributor agreement), by submitting content you: • Represent and warrant that you are the original author or otherwise hold the rights to submit the content, and that it does not infringe any third party's intellectual property, privacy, or other rights; • Grant BLVD a worldwide, royalty-free, non-exclusive, sublicensable license to publish, reproduce, distribute, promote, translate, and archive the content across the Site and associated channels (including social media and syndication partners), for as long as reasonably necessary for editorial and archival purposes; • Retain your underlying authorship credit (byline) and any ownership rights not expressly licensed to us. Compensation Any compensation for contributed content, if applicable, will be governed by a separate written agreement between you and BLVD. Absent such an agreement, contributions are provided on a voluntary or byline-credit basis. Writers Leaderboard and Rankings Contributor performance metrics (e.g., views, engagement, or editorial scoring) may be displayed publicly via the Writers Leaderboard, Rankings, or Author Page features. By contributing, you consent to the display of such public-facing performance data. AI-Assisted Content Any use of artificial intelligence tools in the research, drafting, or editing of contributed content must comply with our AI Usage Disclaimers policy, including any required disclosure obligations.

4. Advertising and Sponsorship

Brand Partnerships BLVD offers sponsorship, advertising, and "sponsorship intelligence" services to brand partners via our Advertise page. Specific commercial terms, deliverables, and fees for advertising or sponsorship engagements are governed by a separate insertion order, sponsorship agreement, or statement of work. Sponsored Content Labeling All sponsored, paid, or advertorial content will be clearly and conspicuously labeled as such, in accordance with applicable advertising disclosure laws and our Journalistic Ethics standards. Editorial independence is maintained regardless of any sponsorship relationship.

5. Acceptable Use

You agree not to: • Use the Services for any unlawful purpose or in violation of these Terms or our Policies; • Impersonate any person or entity, or misrepresent your affiliation; • Upload or transmit content that is defamatory, obscene, harassing, hateful, infringing, or otherwise objectionable; • Upload or submit content that exploits, endangers, or sexualizes minors in any way; any such content will be removed and may be reported to appropriate authorities in accordance with our Child Protection Policy and PSEAH Policy; • Attempt to gain unauthorized access to any account, system, or network related to the Services; • Interfere with, disrupt, or place undue burden on the Site's infrastructure (e.g., via scraping, bots, or denial-of-service activity) without our prior written consent; • Use automated means to extract data from the Site for competitive or commercial purposes without authorization; • Circumvent or manipulate the Writers Leaderboard, Rankings, or other performance metrics. We reserve the right to remove content and suspend or terminate accounts that violate this section.

6. Intellectual Property

BLVD Content All content on the Site, including articles, graphics, logos, the BLVD name and marks, design elements, and compilations thereof (excluding user- and contributor-submitted content licensed as described in Section 3), is owned by or licensed to BLVD and is protected by copyright, trademark, and other intellectual property laws. Limited License to Users We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes (e.g., reading articles, using My Library). You may not reproduce, redistribute, publicly perform, or create derivative works from Site content without our prior written consent, except as permitted by applicable fair use/fair dealing law. Trademarks "BLVD" and associated logos are trademarks of BLVD. You may not use our trademarks without prior written permission. Copyright Complaints If you believe content on the Site infringes your copyright, please contact us at legal@blvd.ph with sufficient detail to identify the work and the alleged infringement.

7. Newsletter and Communications

By subscribing to our Newsletter or creating an account, you consent to receive editorial updates, service notifications, and (where permitted) promotional communications from BLVD. You may unsubscribe from marketing communications at any time using the unsubscribe link or your account settings, though we may still send essential service-related communications (e.g., security or account notices). Where required by law — including Canada's Anti-Spam Legislation (CASL), the U.S. CAN-SPAM Act, or applicable EU/UK e-privacy rules — we obtain appropriate consent before sending commercial electronic messages and include sender identification and a working unsubscribe mechanism in every such message.

8. Events

Registration for any Event listed on the Site (via the Events or Event Detail pages) may be subject to additional terms provided at the time of registration, including capacity limits, code of conduct requirements, and third-party venue or platform terms. BLVD is not responsible for the acts or omissions of independent event organizers, venues, or third-party platforms used to host Events.

9. Third-Party Links and Content

The Site may contain links to third-party websites or content not owned or controlled by BLVD. We are not responsible for the content, privacy practices, or terms of any third-party sites. Your interactions with third parties linked from the Site are solely between you and that third party.

10. Disclaimers

Editorial Content Content on the Site is provided for informational and lifestyle purposes only and does not constitute professional, legal, financial, medical, or career advice. You should seek independent professional advice before acting on any information published on the Site. "As Is" Basis THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BLVD AND ITS OFFICERS, EMPLOYEES, CONTRIBUTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO BLVD, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100) OR ITS PESO EQUIVALENT. Nothing in these Terms limits liability for fraud, willful misconduct, or any liability that cannot be limited or excluded under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless BLVD and its officers, employees, contributors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or connected to: (a) your use of the Services; (b) your violation of these Terms or any Policy; (c) content you submit or contribute; or (d) your violation of any third-party right, including intellectual property or privacy rights.

13. Termination

We may suspend or terminate your access to the Services at any time, with or without cause or notice, including for violation of these Terms. You may terminate your account at any time by contacting us or using available account deletion tools. Sections of these Terms that by their nature should survive termination (including the Intellectual Property, Disclaimers, Limitation of Liability, Indemnification, and Governing Law sections) will continue to apply.

14. Changes to These Terms

We may revise these Terms from time to time. The updated version will be indicated by an updated "Last Updated" date and will be effective as soon as it is posted, unless otherwise stated. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify registered users (e.g., via email or Site notice).

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts of Bacolod City, Philippines, unless otherwise required by applicable law. International Users. BLVD is read, contributed to, and sponsored by users around the world, including in Canada, the United States, the European Union, the United Kingdom, and elsewhere. Nothing in this Section is intended to displace any mandatory consumer protection, data privacy, or other statutory rights that cannot be waived or contractually overridden under the law of your country or province of residence. For example, if you are a consumer located in Canada, mandatory provisions of applicable federal or provincial consumer protection legislation (including, where applicable, provisions addressing online contract disclosures or restrictions on forum-selection and arbitration clauses) will apply to the extent required, notwithstanding the governing law and forum selected above. Similarly, EU/UK and other consumers retain any mandatory local consumer protections that cannot be limited by contract.

16. Miscellaneous

• Entire Agreement: These Terms, together with the incorporated Policies, constitute the entire agreement between you and BLVD regarding the Services and supersede any prior agreements. • Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. • No Waiver: Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, or sale of assets. • Force Majeure: We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control.
